An owners corporation, previously known as a body corporate, manages the common property of a residential, commercial or mixed-use development. Common property refers to the areas owners share and may include gardens, easements, pathways, lighting, carports, driveways and fences.
Owners of townhouses, apartments or units with common property are automatically members of an owners corporation. An owners corporation is created whenever a plan for a development with common property is registered.
Owners corporations for developments of more than three units have legal and financial responsibilities. These include handling repairs and maintenance, maintaining adequate insurance, preparing annual financial statements and reports and having an annual general meeting. They must also ensure an Owners Corporation Certificate is provided when selling a property in an owners corporation development.
Owners corporations can self manage or opt to employ a professional manager.
